Terms of Use
These Terms of Use (“Terms”) govern your access to and the Use of the BizGo platform, websites, and related services (together, the “Service”) operated by GoSoftSolutions (Pty) Ltd. They complement our Terms of Service and Privacy Policy.
By creating an account, starting a free trial, or otherwise using the Service, you (“you”, “your”, the “Customer”) agree to these Terms. If you are agreeing on behalf of a business, you confirm that you are authorised to bind that business. If you do not agree, do not use the Service.
1. Definitions
- 1.1 “Account” — the organisation account you create to use the Service.
- 1.2 “BizGo” — refers to “we”, “us”, “our”, “the service”.
- 1.3 “Customer Data” — data you or your End Users put into the Service, including contact details, messages, quotes, invoices, and job records.
- 1.4 “End User” / “Your Customers” — the people you communicate with or whose details you store and process through the Service.
- 1.5 “GDPR” — Refers to the General Data Protection Regulation. A Privacy and Security law passed by the European Union and the United Kingdom.
- 1.6 “Plan” — a tier of the Service, such as the free trial or a paid monthly plan, with its bundled modules and limits, as shown on our pricing page at sign-up.
- 1.7 “POPIA” — Refers to the Protection of Personal Information Act 4 of 2013.
- 1.8 “Subscription” — your chosen plan and the recurring fees payable for it.
- 1.9 “Terms” — Refers to “Terms of Use”.
- 1.10 “You” — Refers to “you”, “your”, the “Customer”.
2. Your responsibilities and acceptable use
You are responsible for how you use the Service and for the content you send. You agree that you will:
- 2.1 Have a lawful basis for every message and every contact you store or message, for example consent or another lawful ground under the Protection of Personal Information Act 4 of 2013 (“POPIA”), and any other laws that apply to you, including the GDPR where relevant.
- 2.2 Only message people who expect to hear from you, and honour opt-out and unsubscribe requests promptly. The Service provides automatic STOP-keyword handling and unsubscribe footers — you must not circumvent them.
- 2.3 Not use the Service to send spam or unsolicited bulk marketing, phishing or fraudulent content, malware, or anything unlawful, defamatory, harassing, or that infringes another person’s rights; promote illegal goods or services; or violate Meta’s / WhatsApp’s Business Messaging Policy and Commerce Policy.
- 2.4 Be responsible for the WhatsApp number and any WhatsApp Business Account you connect, including any policy violations, bans, or rate limits that Meta or WhatsApp attributes to it. Automating a messaging number always carries some risk; you accept that risk.
- 2.5 Not attempt to gain unauthorised access to the Service, interfere with its operation, reverse-engineer it, resell it, or use it to build a competing product.
- 2.6 Comply with all laws applicable to your business and your use of the Service.
- 2.7 Check every figure the Service calculates for you — including payslips, payroll totals and deductions, leave balances, quotes, invoices, and any tax or statutory amount — before you rely on it, issue it, pay it, or submit it. These are basic calculations based on the information, rates, and settings you enter; verifying them is your responsibility (Terms of Service clause 13).
- 2.8 Keep the information those calculations depend on accurate and current, including employee pay details and pay components, tax and statutory rates, prices, and VAT settings. We do not determine or maintain these for you.
- 2.9 Accept that the Service stores account records, your customers’ details, message content, uploaded files and generated documents on servers in the European Union (Privacy Policy clause 7). Where you are the responsible party for your customers’ personal information, it is your responsibility to have a lawful ground for that cross-border transfer under section 72 of POPIA and to give your customers any notice or obtain any consent this requires. Your acceptance of these Terms is your instruction to us to store and process that data in those locations.
You are solely responsible for your messages and Customer Data, and for the accuracy of the payslips, quotes, invoices, and other documents you produce with the Service. We may, but are not obliged to, monitor use of the Service for policy and legal compliance.
